Does the Korean court make a fair judgement in civil litigation? Foranswering to this question, I defined fairness as consent of litigants to thejudgement, and measured the level of consent using appeal rate. The appealrate of civil litigation in Korea is not particularly higher than that of Japan,which belies the popular belief. However, continuing effort to enhance thelevel of fairness should be made. For this regulations on supply of lawyersshould be abolished, and enough number of judges should be hired.Regression analysis supports this argument.
